Eligibility to Play

This web site and participation in the activities on this web site is restricted in certain circumstances. Participation in the activities and games of GameAccount (the "Game" or "Games") is open only to residents of those jurisdictions where such participation is legal and not prohibited by law, including by way of age. Any Games that are played for money or prizes are additionally only open to individuals of legal age of majority only, in the jurisdiction in which you reside. You cannot play under any circumstances if you are not at least eighteen (18) years of age; minors may not play; residents in the

Games

The Games found on www.GameAccount.com are a mixture of:

  • person-to-person or multiplayer games of skill and chance combined;
  • one player games of skill and chance combined; and
  • one player games of chance.

Certain Game rules may have been modified slightly due to the nature of the web site and the internet.

Session Completion

Once a one player Game commences it will continue until:

  • you win;
  • you lose;
  • you resign; or
  • your connection is terminated for any reason or the game window is closed.

In the event of a multi-stage one player game where there are still active bets of real currency on the table, the game state will be stored and may be resumed at a later date for a period of 90 days. Funds attached to games which remain incomplete after 90 days will be donated to charity.

Once a person-to-person Game commences it will continue until:

  • you win;
  • you lose;
  • you resign; or
  • your connection is terminated for any reason in which case you will be deemed to have lost the Game if you cannot reconnect to the Game while it is still in progress (please see the terms of our disconnection policy as set out below). If you lose your connection during a game of Pro Blackjack, in which you were in the middle of playing out one or more hands of blackjack, your session will persist and you will be able to login to the web site, re-launch the Pro Blackjack Game and continue your hand or hands of blackjack. If you do not re-connect to continue play of this session of Pro Blackjack after the elapse of thirty (30) days your funds will be donated to charity in accord with the requirements of the Alderney Gambling Control Commission.

In the event that:

  • a disconnection occurs; or
  • you close the game lobby window (which closes all game tables); or
  • you close the game table window,

your game will be paused and your opponent notified of your disconnection. If you log back in and re-enter the game lobby within 2 minutes you will be given the opportunity to rejoin your game table (the “Disconnect Protection). In the event you do not reconnect within the two minute period your opponent will be deemed the winner and your stake or liability will be forfeited.

Our software will detect whether there has been a genuine disconnection. If you try to claim Disconnect Protection by simply getting 'timed out', you will be deemed to have resigned from the game. Disconnect Protection is not to be used for any purpose other than a genuine disconnection. Any intentional disconnections from the game lobby or game table may result in forfeiture of winnings or expulsion from the site.

In the unlikely event a real money game in progress is cancelled due to technical issues, both players will be automatically refunded their buy-ins, regardless of the players’ standing when the game was halted. We reserve the right to render final decisions on all matters herein at our sole discretion. Refunds will be communicated via electronic mail.

Availability of Games

We reserve the right, in our sole and absolute discretion and without liability, to cancel or suspend a Game should a virus, bug, worm, communication or server failure occur or for any other reason we deem necessary.

Password Responsibility

Modification of Terms and Conditions

Any such modifications and amendments will take effect upon posting. We reserve the right to amend any of these Terms and Conditions from time to time as we deem fit.

Representations & Warranties by Players

By doing any of the following things:

  • entering the web site;
  • opening and using an account on the web site;
  • playing Games on the web site; and
  • accepting any prize,

you hereby represent, warrant and certify all of the following:

  • you are not required to participate in the Games;
  • participation in the Games, if elected by you, is at your sole option, discretion and risk;

  • you acknowledge that the chat room facility is provided solely to enhance your or your opponent's enjoyment of a Game. You will not use the chat room facility to post any obscene, racist, sexist, defamatory, inflammatory or otherwise objectionable wording in accord with our Code of Online Conduct set out below. If you do so you will hold us harmless from any loss, damage, cost or expense of whatsoever nature or howsoever arising therefrom including but not limited to loss of business, profit, extraordinary or punitive damages, any fines or penalties. We may terminate your Account and your access to any Games or prizes;
  • you acknowledge that we, without liability or responsibility, may in our absolute discretion:

i. decline to accept the registration of any person to this web site;

Collusion, Cheating and Fraud

If you are playing any head-to-head or multiplayer Game in competition against or seated with other players of the same Games you cannot see or identify those players who you are playing against or with (other than by username or alias published in the software environment) and they may be:

  • colluding with other third party players; or
  • using unfair external factors or influences (commonly known as cheating); or
  • undertaking fraudulent activities to your disadvantage and their advantage.

Such practices are not allowed and we will take all reasonable steps to prevent them.

If you suspect any player is cheating or colluding or undertaking a fraudulent activity it should be reported to us immediately by email to customerservices@GameAccount.com identifying the player or players’ usernames or aliases involved and containing a brief description of their suspect activities.

We reserve the right to terminate your account, withhold or confiscate in full or part (at the unfettered discretion of the customer services staff) the balance of your account and in doing so recover from your account the amount of any affected prize pay-outs, bonuses or winnings if:

  • you are found to be or reasonably suspected to be participating in any form of collusion or fraudulent practice;
  • we become aware that you have gamed with any other online provider of gaming or gambling services and are suspected (as a result of such play) of fraud, collusion (including in relation to charge-backs on bank cards) or unlawful or improper activity;
  • we becomes aware that you have begun proceedings to "charge back" a bank card or have denied any of the transactions made on your account; or

You agree not to download, rent, lease, loan, distribute, create derivate works, copy, re-use, modify, adapt, attempt to decompile, decipher, disassemble, reverse engineer, decrypt or discover the source code of all or any portion of the Games, create improvements, or seek to obtain intellectual property protection on the content of and intellectual property rights in the Games.

Wagers are only valid if accepted by our server. Until acceptance of the wager by our server all information displayed relating to a Game constitutes an invitation to play only. In addition, we strongly recommend to our players that they withhold their email addresses from other players at all times in order to avoid the risk of onward distribution or publication of these to unauthorised companies or persons. We will not release email addresses to unauthorised third parties unless required to do so by operation of law or regulation and we request that our players extend that privilege to each other.

Deposit Limits

You may email our customer services staff at customerservices@GameAccount.com in order to set an absolute limit on your aggregate deposits which, when exceeded, will result in your account being suspended until such time as you have completed the requisite declaration form for re-opening your account contrary to your requested deposit limits. We are not responsible for monitoring your deposit limits on a periodic basis although customer services staff will monitor your aggregate deposits no less than once per calendar month following your deposit limit request which must be made by email only and specifically acknowledged by a member of customer services staff. Promotional Offers

  • You may be awarded ‘free credit’ to use on the web site by accepting a promotional offer. Free credit is turned into real cash as you play cash games.   • Each Promotion is available only once per customer. Withdrawals

Subject to the rules set out below you may request a withdrawal at any time of all cash amounts stored in your account without incurring a withdrawal fee. Withdrawals will typically be processed within 3-5 working days following your request (although bank transfers to your nominated bank account may take 5-7 working days). In some cases we may need to contact you requesting identification prior to authorising the withdrawal. If your account is denominated in USD($), EUR(€) or AUD(AUD$):

  • Neteller or Moneybookers Accounts. We will make payment of the requested amount to a valid Neteller or Moneybookers account which is held in your name. You must specify the Neteller or Moneybookers account name if this differs from your current registered e-mail address. We are able to make the repayments in any of the currencies accepted by Neteller or Moneybookers; or

Withdrawal Administration Fees. In general we do not charge customers for making a withdrawal albeit with a handful of exceptions. Management Fees

We will charge you a management fee (the "rake") for competing in wagered games.

The fee for fixed-stake matches on our multiplayer games is 5%-7.5% of the total of both players' stakes, taken from the winner's earnings. The rake for each wager is settled separately (for example, if you wager £10 each in a two-player game, then the loser loses £10 and the winner receives £9.) Of the £20 staked in this example, we retain £1 (or 5%). For low stake wagers, eg. £1 fixed-point games, we may charge a slightly higher rake percentage.

We charge this fee to cover our costs of development, hosting and maintenance and share any profits with commercial partners (including, but not limited to, customer sites and games software developers). If you win then your account will be credited with the amount of the agreed wager less our management fee. If you lose then your account will be debited by the amount of the agreed wager.

In the case of a tie for any wager, the winnings for that bet will be equally divided between those players who are tied. Each wager will be settled independently and a separate management fee will be charged to each wager.

Dormant Accounts

Your account will be deemed a “Dormant Account” in the event you fail to use your account for a single continuous period of 90 days or more. Use of your account may be constituted by:

  • the purchase of one or more tournament entries;
  • placing one or more wagers in a multiplayer game;
  • depositing funds within your account; or
  • withdrawing funds from your account.

All Dormant Accounts with funds remaining shall be subject to an inactivity charge of 2 currency units for each calendar month following and including the first month in which your account is deemed a Dormant Account. After your account has been deemed a Dormant Account and has subsequently been dormant for an additional nine (9) calendar months, your account shall be deemed an “Abandoned Account” and the sum total of cash held in your account will be donated to charity.

In the event that you return to the web site in order to carry out any one of the previously stated financial transactions and your account has been previously deemed either a Dormant Account or an Abandoned Account and therefore subject to one or more inactivity charges or donation to charity, please contact Customer Services for a review of your account.

Intra-account Transfers & Associated Fees

This Refer-a-Friend Promotion ("the Referral Promotion") is only open to existing registered cash players of the Games on the web site (the "Referrer"). The referred friend must be a new registered cash player of the Games offered by us ("Referred Friend").
